Applies To: All customers, clients, partners, and users of Harle Tech services and products.

At Harle Tech, we respect the intellectual property rights of others and expect our customers to do the same. This Intellectual Property & Copyright Policy outlines the standards, responsibilities, and guidelines governing the submission of images, graphics, text, and other materials used in our customisation and photo-engraved gift services.

1. Overview & General Policy

Harle Tech provides personalised manufacturing and custom laser engraving services. To perform these services, customers upload, submit, or provide visual assets (including photographs, digital artwork, logos, and text). Harle Tech does not knowingly reproduce, engrave, or manufacture items that infringe upon third-party copyrights, trademarks, or other proprietary rights.

2. Customer Representations & Warranties

By submitting any photograph, image, graphic, or design to Harle Tech for custom engraving or personalisation, you (the customer) explicitly represent and warrant that:

  • Ownership & Authorisation: You are the sole copyright holder of the image, or you have obtained explicit, written permission or a valid licence from the copyright owner (e.g., professional photographer, graphic artist, brand owner) to reproduce and engrave the image.
  • Third-Party Rights: The submitted content does not violate, misappropriate, or infringe upon any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or any other proprietary right of any third party.
  • Model Releases: If the submitted photo includes identifiable individuals (other than yourself), you have obtained all necessary consents and releases to permit Harle Tech to reproduce their likeness on the product.

3. Customer Photo Engraving & Custom Gift Guidelines

Because photo-engraved gifts rely entirely on customer-supplied imagery, the following specific rules apply to all submissions:

A. Permissible Submissions

  • Personal photographs taken directly by you (e.g., family photos, personal pets, landscapes).
  • Images or artwork in the public domain.
  • Original artwork created entirely by you.
  • Corporate logos or imagery for which you are an authorised representative or licence holder.

B. Restricted & Prohibited Content

Harle Tech reserves the right to refuse, reject, or cancel any engraving request that includes:

  • Professional Photographs: Watermarked or un-watermarked photos clearly taken by professional photographers (e.g., school portraits, wedding photography, studio shots) unless accompanied by a written release or licence.
  • Trademarks & Copyrighted Characters: Unlicensed logos, mascots, Disney characters, movie/TV stills, album covers, sports team logos, or celebrity photos.
  • Defamatory or Illegal Content: Images that promote hate speech, illegal acts, or violent or obscene content.

4. Review Process & Right of Refusal

Harle Tech reviews submitted images for engraving suitability and potential copyright concerns prior to production. However, Harle Tech is under no obligation to conduct copyright searches or legal verification on submitted imagery.

If Harle Tech suspects that a submitted image infringes upon a third party’s intellectual property rights, we reserve the right to:

  1. Request proof of authorisation, copyright ownership, or a signed release form from the customer.
  2. Pause or place the order on hold until satisfactory proof of rights is provided.
  3. Cancel and refund the order if proof of authorisation cannot be provided within a specified timeframe.

5. Indemnification & Liability

The customer agrees to defend, indemnify, and hold harmless Harle Tech, its owners, employees, agents, and successors from and against any and all claims, damages, losses, liability, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Any claim that an image or design provided by the customer infringes or violates any copyright, trademark, privacy, or proprietary right of a third party.
  • Any breach of the representations and warranties set forth in this policy.

6. Infringement Notices & Takedown Requests

If you are a copyright holder or an authorised agent thereof and believe that any material processed or displayed by Harle Tech infringes upon your copyright or intellectual property rights, you may submit a written notice to our designated contact containing the following details:

  • A physical or electronic signature of the person authorised to act on behalf of the copyright owner.
  • A description of the copyrighted work claimed to have been infringed.
  • Identification of the material or product in question and details sufficient to locate it.
  • Your contact information (address, telephone number, and email address).
  • A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate and that you are authorised to act on behalf of the copyright owner.

7. Policy Amendments

Harle Tech reserves the right to modify or update this policy at any time. Any revisions will take effect immediately upon posting to our official website or distribution to customers.
